Warranty claims involve seeking remedies for defects or issues with products that are covered by a warranty. In India, warranty matters are governed by the Consumer Protection Act, 2019, which outlines the obligations of sellers and manufacturers to honour warranty agreements and provide appropriate remedies for faulty products. At Zolvit, we understand the complexities of warranty claims and are committed to providing tailored legal solutions to address your concerns effectively.
Warranty related claims are governed by several key laws and regulations in India. The Consumer Protection Act, 2019 by creating a broad framework Citizen rights such as warranties and guarantees have been ensured to protect the citizens. The Sale of Goods Act, 1930 describes the various rights and restrictions attached to sales or purchase of goods including implied contracts. In India, apart from the CP Act regulations that I spoke about in my previous recently-posted article on faulty mobile handsets, we also have Indian Contract law 1872 which deals with contracts and sets out legal obligations between parties or warranties.
A warranty claim refers to a consumer assertion that the product is faulty and must be repaired or replaced with special provisions in an agreement. This means that manufacturers and sellers are held responsible for making good on their promises to deliver quality. A warranty in India is a legal assurance incorporated in the agreement for sale of any goods and service that an item or service being sold will be free from faults. Most warranties provide remedies of repair or replacement if the good or service fails to meet their terms. If a warranty is violated, buyers can not refuse to accept the goods but they may claim damages for compensation of the violation.
Lawyers offer consultation to evaluate warranty claims and advise on legal recourse. They take the writing and submission of formal complaints to consumer forums or judicial bodies. Lawyers help in finding out and inspecting details associated with the warranty claims. They work to reach a settlement or remedy with the manufacturer, seller without involving court. Lawyers, when needed, go to court and act on litigation behalf of the clients, making their case be heard and getting recourse through consumer protection tribunals/ other judicial forums.
