                  Did you know?

Mumbai, Delhi, Kolkata, Chennai, and Ahmedabad are India's five trademark registry offices. When a trademark is registered, its holder gets special rights to its use and is protected by law against infringement. The limitation period for registered trademarks is ten years. At the request of another party, a trademark may be cancelled if it has not been used for five years.

Non-renewal has severe consequences. As a result, any other person could claim the trademark and register it in their name.

                  An Overview of Trademark Renewal

The registration of a trademark in India expires after 10 years from the registration date. You can keep a trademark permanent by filing a trademark renewal application online or offline by paying the necessary renewal fees every 10 years to keep the trademark permanent. The application must be filed within six months from the date the registration expires to be considered valid. It is possible to keep your trademark perpetual and permanent by renewing your trademark in India, as there are no restrictions on how many times you wish to renew your trademark and for how many years you want to keep the trademark status active and registered.

Benefits of Trademark Renewal in India

                  • Avoiding Frivolous Lawsuits

A seamless trademark protection is possible without the risk of litigation. When trademarks are renewed, no one can claim rights over them other than the trademark owner.

                  • Ownership Rights Expansion

wIt is possible to protect a brand name from infringing. After each renewal, the trademark's exclusive rights are extended for 10 years. As a result, your brand and goodwill are permanently protected.

                  • The Security of Brand Names

The renewal of a trademark ensures continuous and unhindered protection of the brand name. When a brand name is not renewed, it loses its legal defence.

                  • Returns on Capital

A trademark owner can assign or license the mark for some monetary compensation to someone else. As a result, a registered trademark can also be profitable.

                  Checklist For Trademark Renewal

                  • A registered trademark owned by the proprietor, subject to renewal
                  • Commercial use should be considered when determining eligibility
                  • Conduct a trademark search of the eminent and licensed trademark databases to ensure there are no similar trademarks
                  • It is prudent to get a legal opinion if there is a conflict of trademarks
                  • Prepare a renewal application and comply with the conditions of renewal.

                  Trademark Renewal With Zolvit

There's a three-step process for renewing a trademark with Zolvit.

                  Step 1: Requirement

Once you send us your details, a representative will contact you to discuss your requirements and explain the process and charges. A trademark renewal or restoration would incur different charges.

                    Step 2: Renewal Application

We will begin working on your Trademark Renewal application and prepare the necessary documentation. In addition to renewal fees, Form-10 or Form-12 must be filed with the registrar.

                      Step 3: Confirmation

Within four to five months, you will receive confirmation that your trademark has been renewed for another decade.

                        FAQ's

An online trademark renewal application must be filed no earlier than one year before the expiration of 10 years from the date of application. Trademark Renewal applications after the expiration of a period of 10 years require additional fees. Thus, it is ideal for applying for renewal 6 months before the expiration date.
A trademark renewal may be delayed for six months after the expiration of ten years by the Registry of Trademarks. An application for Trademark Renewal in India can be made online after the expiry of 10 years with an additional fee.
To continue using an expired trademark, you must apply for restoration within 6 months of its expiry date. However, a 6-month delay can be risky and result in additional fees and documentation.
Non-renewal has severe consequences. As a result, any other person could claim the trademark and register it in their name.
Renewal of a trademark does not alter the rights of the trademark holder. The trademark holder would be entitled to all rights acquired during the primary registration as long as the trademark is valid.
It is usually the case that trademarks are territorial and are valid only in the country where they are filed. Registration can be filed separately in each country, which can be expensive, or you can submit an application via WIPO or CTM for international registration.
