Types of Patents

Types of Patents in India are categorised into some classes according to their nature and scope. The major types of patents recognised under Indian patent law are:

  • Invention Patents: Invention patents are granted for new and useful products or processes. The invention must be new, involve an inventive step, and be able to carry out industrial applications. An invention may be, for example, a product, process, or method .
  • Utility Patents: These are often called ‘patents for new inventions,' and they protect new, useful processes, machines, or compositions of matter. Further, they need to meet the essential conditions of novelty and nonobviousness as well as be applicable in an industry.
  • Design Patents: Design protection under the Indian Design Act extends to cover the new and original design of an article, though it is not technically referred to as a ‘patent’ in a traditional sense. It refers to the form, features, or combination of both applied directly to a product, creating its visual appeal.
  • Process Patents: These patents are available for a new production method or process. In pharmaceuticals and chemicals, the process of production is often almost as important (e.g., yields, purity) for patenting as the product itself, so they also allow patents on processes called "process patents.".
  • Product patents: Patents that cover new products or compositions of matter. Product patents are easier to understand, and they protect the product itself (e.g., a new drug or a novel material).
  • Patent of Addition: A patent for an improved or updated version of a patented invention. It permits the intellectual to extend the protection of new inventions that are similar to the original patent.
  • Rule for Divisional Patents: If a patent application discloses more than one invention, such as in the case of an original filing without divisions or claims to priority, then divisionals may be used. At what point in time could each divisional application cover a different inventive subject matter than the original application.
  • Normal application: An ordinary type of application is the most common type which is filed by the applicant directly at the patent office.
  • Convention Application: It is filed in the convention application of an applicant who has already made a patent application on one date.
  • PCT International application: It is governed by the Patent Cooperation Treaty (PCT) and processed in all 153 member countries.

The Indian Patents Act, 1970, also governs the procedure of filing applications and obtaining approval for each type of patent, which is controlled by the Office of the Controller General of Patent Design and TradeMarks.

Types of legal Process for Patent Issues In India

There are a number of legal procedures framed by the patent rules in India to provide protection to your innovation and, at the same time, resolve disputes. A glance at the main processes and their operations:

  • Patent Infringement: Patent infringement is the unauthorised use of a patented invention. It can be direct; it can also be indirect or circumstantial and result in a violation of exclusive rights given to a patent. Patent holders could theoretically sue to prevent unauthorised use and for damages.
  • Patent Litigation: It refers to a legal proceeding for enforcing patent rights and disputes about infringement. This may involve filing lawsuits, defending against infringement claims, or seeking remedies such as injunctions and damages. This sometimes complex process may even go to court, where the infringement and validity of such a patent are disputed.
  • Judicial Review: The right of the higher courts to review decisions by the Patent Office or lower court in patent cases. Engaging in this process is what ensures the correct interpretation of patent laws and gives a mechanism to appeal if mistakes go uncorrected. Those displeased with a determination can file for a judicial review to contest and even reverse the ruling.
  • Patent Trolls: Patent trolls, also known as non-practicing entities (NPEs), purchase patents simply to sue others for infringement instead of creating or selling the inventions. They frequently resort to the threat of litigation, forcing settlements or licensing fees as they abuse a patent system intended for just that.
  • Prior Art Search: A search of existing patents, publications, and other public resources to determine the novelty of an invention. This is a critical part of determining patentability as well as ensuring no infringement on prior art.
  • Patentability Analysis: This analysis studies if an invention satisfies the conditions for obtaining a patent, such as novelty, non-obviousness and its industrial applicability. Through this analysis, the inventor or company has a decision on whether to go forward with patenting and an idea of what might be protected.

Penalties and Consequences

Fines for patent infringement can be imposed by the court as part of the legal penalties. These fines are intended to punish the infringer and deter future violations. Infringers may be required to pay compensation to the patent holder for damages resulting from the infringement. This compensation aims to restore the patent holder's financial position and cover any losses incurred.
